Notice of Passing of a Zoning Bylaw 2023-40P

TAKE NOTICE that the Council of the Municipality of Marmora and Lake passed bylaw 2023-40P on the 1st day of August 2023 under Section 34 of the Planning Act, 1990, as amended. 

PURPOSE AND EFFECT OF BYLAW 2023-40P The purpose and effect of the zoning bylaw amendment is: To rezone the subject lands from Waterfront Residential (WR) Zone to Waterfront Residential Exception No. 1 (WR-1) Zone to permit the minimum required front yard setback for a dwelling to be 19.2 m (63 ft), the minimum required front yard setback to a deck/porch to be 17 m (55.8 ft), and minimum setback to a Mineral Extractive (MX) Zone shall be 37 m (121.4 feet). The affect of the amendment will permit the development of a dwelling on the subject lands located on Deloro Road, Marmora, ON legally described as Concession 10, Part Lot 16, Part 5 on Registered Plan 21R-9655; Municipality of Marmora and Lake, Hastings County. 

AND TAKE NOTICE, under the Planning Act Section S.34 (19) any person or public body may, not later than August 22, 2023, appeal to the Ontario Land Tribunal in respect of the bylaw by filing with the Municipal Clerk the Appellant Form (A1) setting out the reasons for the appeal and accompanied by the prescribed fee $400.00 payable to the Minister of Finance.   

Only individuals, corporations and public bodies may appeal a zoning bylaw to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.   

No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party. 

Any and all written and oral submissions relating to this application that were made to the Municipality of Marmora and Lake before its decision in relation to zoning by-law amendment no. 2023-40P have been, on balance, taken into consideration by the Council of the Municipality of Marmora and Lake as part of its deliberations.
