Notice of Passing of a Zoning Bylaw 2024-03P
TAKE NOTICE that the Council of the Municipality of Marmora and Lake passed bylaw 2024-03P on the 16th day of January 2024 under Section 34 of the Planning Act, 1990, as amended.
PURPOSE AND EFFECT OF BYLAW 2024-03P The purpose and effect of the zoning bylaw amendment is: To rezone the severed lands from Marginal Agriculture (MA) Zone to Rural Residential Holding (RR-H) Zone on the subject lands located on 136 Glen Ridge Road, Marmora, ON, legally described as Part Lot 9, Con. 4, Part 1 Registered Plan 21R-2339 and Part 1 on Registered Plan 21R-13620; Municipality of Marmora and Lake, . Hastings County as a condition of consent File B58/22 and B59/22. The “Holding (-H)” symbol is to be lifted once the extension to Glen Ridge Road is constructed to a municipal standard and assumed by the Municipality.
AND TAKE NOTICE, under the Planning Act Section S.34 (19) any person or public body may, not later than August 22, 2023, appeal to the Ontario Land Tribunal in respect of the bylaw by filing with the Municipal Clerk the Appellant Form (A1) setting out the reasons for the appeal and accompanied by the prescribed fee $400.00 payable to the Minister of Finance.
Only individuals, corporations and public bodies may appeal a zoning bylaw to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
Any and all written and oral submissions relating to this application that were made to the Municipality of Marmora and Lake before its decision in relation to zoning by-law amendment no. 2023-41P have been, on balance, taken into consideration by the Council of the Municipality of Marmora and Lake as part of its deliberations.
